The NBA has named Kalshi and Polymarket as preferred prediction-market exchanges and signed a data-sharing agreement with the CFTC to safeguard against insider trading, cementing the league's spot on the regulator's side of the U.S. prediction-markets fight while the NFL continues to resist.
The move aligns the NBA with the CFTC, which has championed firms such as Kalshi as it consolidates event-contract oversight. It deepens the split among major sports leagues over whether prediction contracts fall under CFTC jurisdiction or state gambling law, with the Sixth and Eighth Circuits backing state oversight and the Third Circuit backing the CFTC.
